GENERAL TERMS AND CONDITIONS FOR THE ASTALUNA FESTIVAL

1. TICKETS AND CONTRACTUAL RELATIONSHIPS

  1. The ticket buyer and the student body of RWTH Aachen K.d.ö.R., represented by the General Students' Committee (AStA), hereinafter referred to as the organizer, become contractual partners with the purchase of a ticket. Tickets for the event are available via our ticketing platform pretix. The provisions of these GTC also apply to visitors to the festival site who have received a ticket via a raffle or are on the guest list; these persons agree to the provisions of these GTC by entering the festival site and also become contractual partners of the organizer. In the following, these contractual partners are referred to as visitors.
  2. It is expressly pointed out that there is no 14-day right of revocation for purchase contracts for tickets with a fixed event date in accordance with § 312g (2) sentence 1 no. 9 BGB. It will be possible voluntarily and without acknowledging a legal obligation to cancel purchased tickets free of charge until 09. april 2026. Cancellations after this deadline will be subject to a cancellation fee equal to the full amount of the ticket price.
  3. The subject of the contract is the attendance of the event "astaluna Festival" in Aachen from 17. april 2026 to 18. april 2026 (hereinafter referred to as the event). Tickets are only valid for the days of validity printed on them.
  4. Private sale of tickets at a higher price than the price printed on the ticket is not permitted. Commercial resale of tickets is prohibited. A competition or a raffle of tickets may only take place after written permission from the organizer.
  5. If a ticket is lost, there will be no admission. The same applies if the ticket presented by the visitor is not legible.
  6. The law of the Federal Republic of Germany applies, the place of jurisdiction is Aachen. The language of the legally binding contract is German.

2. SECURITY CHECKS, ADMISSION & RE-ENTRY

  1. A valid ticket must be presented at the entrance to the festival grounds. Without a valid ticket, admission will be denied. The presented admission ticket will be validated by the organizer and the visitor will receive a stamp imprint, which serves as access control.
  2. Validated tickets no longer entitle the holder to (re)admission. The stamp imprint must be shown at the entrance on request.
  3. If the event is left, the ticket loses its validity and does not entitle you to re-enter. The organizer can voluntarily and without any resulting obligation to grant readmission.
  4. The security service commissioned by the organizer is instructed to carry out body and bag checks. Each visitor agrees to this control. If a visitor does not agree to the controls, admission to the festival site can be denied. In this case, the visitor is not entitled to a refund of the ticket price.
  5. The organizer reserves the right to deny admission to the festival site for good cause. The reasons for this include, but are not limited to, the carrying or wearing of obviously inhumane, racist, homophobic, sexist or otherwise discriminatory clothing, flyers, flags, stickers or posters as well as the carrying of dangerous objects (e.g. weapons of all kinds, torches, intoxicants/narcotics, propane gas bottles, glass containers, tools such as hammers, hatchets, axes and the like, pyrotechnics of any kind, furniture and bulky waste, Car batteries, jukeboxes, generators, drones, environmentally hazardous substances and other dangerous objects, which will be announced via www.astaluna.de/infos in the run-up to the festival. Bags and backpacks with a size of more than DIN A4 are also not allowed. The prohibition of other items is the responsibility of the staff on site. This must be followed. Carrying the above-mentioned items with you will result in exclusion from the festival. There is no entitlement to reimbursement of costs or damages. Dogs and other animals are also not allowed. If food and drinks brought along are not voluntarily handed over, admission will also be denied.
  6. Unauthorized carrying of sound and/or video recording devices (listed in detail under Section 7) will result in denied entry. Accredited representatives of the press and groups of persons commissioned by the organiser may also carry the equipment referred to in section 7.
  7. For persons who require supervision because of their mental or physical condition, the organizer assumes no obligation to carry out such supervision.

3. PROTECTION OF MINORS

  1. The provisions of the Youth Protection Act apply to the entire festival site. Anyone who violates this risks being reported to the police and can be expelled from the event site. A refund of the admission price or compensation for damages are excluded in this case.
  2. Access to the festival site is only permitted to persons of legal age.

4. CANCELLATION OF OR DURING THE EVENT, DELAY & CHANGE OF PROGRAM

  1. If weather conditions or other external circumstances pose a danger to the persons on the festival grounds, the ongoing event will be interrupted or the event that has not yet started will be cancelled or postponed.
  2. If the event is cancelled before the start of the event due to official instructions or for reasons of force majeure or is cancelled after it has begun, there is no claim for damages, unless the organiser can be accused of intent or gross negligence. However, upon presentation of the purchased ticket and the purchase receipt, the visitor will be refunded the ticket price. In the event of partial cancellation of the event (on a daily basis), there is no claim for damages – except in cases of intent or gross negligence on the part of the organiser – but the visitor will be refunded the proportionate ticket price.
  3. The event may be rescheduled by the organizer due to impossible or unreasonable implementation. Relocation: within the same city or neighbouring municipalities. In this case, there is no entitlement to compensation or reimbursement of the ticket price.
  4. The event can be cancelled by the organiser up to seven days before the start of the event if the number of participants is too low or for another important reason for which the organiser is not responsible. In this case, there is no claim for damages. In this case, the ticket price will be refunded in full.
  5. Delays of no more than 2 hours are to be accepted by the visitor.
  6. In the event of an artist's cancellation, the organizer will try to find an appropriate replacement. The visitor is not entitled to compensation or reimbursement of the ticket price due to the cancellation of individual artists.
  7. Changes to the stage program will be announced by the organizer as soon as possible.
  8. The organiser is entitled to have certain areas or even the entire event site temporarily cleared for safety reasons. The organizer is trying to reopen the affected areas as soon as he can be responsible. In this case, there is no entitlement to compensation or reimbursement of the ticket price.

5. PROHIBITIONS & DOMICILIARY RIGHTS

  1. The organizer has domiciliary rights on the entire festival grounds. This is enforced or exercised by the commissioned security service. The instructions of the security service and the organizer must be followed.
  2. Commercial activities (in particular the sale of goods, food or beverages as well as the distribution of flyers and advertising of any kind) are generally prohibited on the festival grounds. This requires written consent from the organizer.
  3. Climbing on stages and other structures as well as stage diving is strictly prohibited.
  4. Commercial collection of deposit containers is prohibited.
  5. If a visitor violates the provisions of these terms and conditions or if a visitor endangers the orderly running of the event or the health of himself, other visitors, artists or employees of the organizer, he may be expelled from the festival site. In this case, the visitor concerned is not entitled to compensation or reimbursement of the ticket price.
  6. Any form of vandalism will be reported without exception and will lead to exclusion from the event.

6. FOOD & BEVERAGE

  1. Bringing plastic bottles, canisters, glass containers of any kind, PET bottles, cans and/or other drinking containers as well as bringing your own food/drinks or food, hard packaging and cooler bags are generally prohibited. Excluded are a 1L tetra pack of water (originally sealed!) and foldable plastic bottles that have a volume of no more than 0.5l. The organizer can make further exceptions, which will be announced in advance via astaluna.de.
  2. The organizer can charge a deposit on dishes and cups for serving food or drinks, or use a comparable system. A deposit charged will only be refunded if the cup is returned intact. Likewise, a free exchange of cups only takes place when an undamaged cup is returned.
  3. If food or beverages are purchased from restaurateurs on the festival site who are not identical with the organizer, there is a contractual relationship with regard to these foods or beverages exclusively with this restaurateur.

7. RECORDING DEVICES & RECORDINGS

  1. Visitors are only allowed to take photos on the festival grounds with mobile phones with camera function and only for private use.
  2. Visitors who carry cameras with zoom lenses, interchangeable objects and/or video function as well as recording devices for image and/or sound (MP3/MP4 recorders, dictation devices, etc.) or other semi-professional or professional recording equipment may be refused entry.
  3. Recordings and/or recordings made without the permission of the organizer are prohibited. In the event of publication of such recordings, criminal and civil prosecution will ensue. If a visitor violates the copyright or usage rights of the performing artists by publishing recordings and/or recordings, he must compensate the organizer and/or the rights holders for the resulting damage.
  4. By entering the event, the visitor irrevocably agrees that image, sound and video recordings of him may be made by the organizer or by third parties accredited by the organizer and may be used free of charge for advertising and/or reporting purposes. This includes, in particular, publication on the Internet and social networks.

8. ARRIVAL / PARKING

  1. There are no reserved parking spaces available at the event area.
  2. The use of public transport or nearby parking facilities is recommended.

9. LIABILITY

  1. To the extent permitted by law, the organiser assumes no liability for personal injury or property damage caused by itself or third parties, as long as the organiser or its vicarious agents are not at fault intentionally or through gross negligence.
  2. The organizer recommends that visitors bring suitable hearing protection.

10. MISCELLANEOUS

  1. Payment at the astaluna Festival is completely cashless. All purchase processes are handled exclusively with EC & credit cards as well as Google & Apple Pay. Only in the case of band merchandise does the organizer have no influence on the payment method of the respective artists.

11. SEVERABILITY CLAUSE

  1. Should individual provisions of this contract be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, the validity of the remaining contract shall remain unaffected.
